Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DailyDeck platform at DailyDeck.ai and DailyDeck.io (the "Service") provided by DailyDeck LLC ("DailyDeck," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

• "Account" means a unique account created for you to access our Service.
• "User Content" means content submitted, uploaded, or otherwise made available by you through the Service.
• "Subscription" means a paid plan granting access to specific Service features for a recurring term.

2.1 Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction.

2.2 Registration

You agree to provide accurate, current, and complete information when creating your Account and to keep it updated. You may not share your credentials or create an account using a false identity or information you do not have the right to use.

2.3 Security

You are responsible for safeguarding your Account credentials and for all activities under your Account. Notify us immediately of any unauthorized use.

You agree not to, and will not permit others to:

• Use the Service in violation of any applicable law or regulation.
• Upload, post, or transmit malware, harmful code, or illegal content.
• Attempt to disrupt, degrade, or impair the Service or its security.
• Reverse engineer, decompile, or otherwise attempt to derive source code.
• Misuse the Service to send spam or unsolicited communications.
• Infringe or misappropriate intellectual property or privacy rights.

4.1 Plans & Renewals

Paid plans and current pricing are listed on our pricing page. Subscriptions renew automatically at the end of each billing cycle unless canceled.

4.2 Payments & Taxes

You authorize us and our payment processors to charge your payment method for applicable fees, taxes, and charges. You are responsible for any taxes associated with your Subscription.

4.3 Upgrades, Downgrades, and Cancellations

Plan changes may take effect immediately or at the next billing cycle, depending on the change. You can cancel at any time. When you cancel, your subscription returns to the Free plan right away, and your paid features end at that point.

4.4 Refunds

Fees are non-refundable except where required by law or explicitly stated by us.

The Service may interoperate with third-party products or services. Your use of those services is governed by their terms and privacy policies, and we are not responsible for their actions or content.

We may offer features labeled as alpha, beta, or preview. These features are provided for evaluation, may be modified or discontinued at any time, and are provided "as is" without warranties.

We strive for high availability but do not guarantee uninterrupted Service. We may perform maintenance, updates, or changes without prior notice. Support is available through our support page and by email at jacek@dailydeck.io.

For Max subscribers, we target a first response within one business day. For all other plans, response times may vary. This is a target for a first response, not a resolution time, and support is not staffed 24/7.

We and our licensors own all rights, title, and interest in and to the Service. You grant us a non-exclusive, worldwide, royalty-free license to use your User Content solely to provide and improve the Service. If you choose to send us feedback or suggestions, you grant us a royalty-free license to use them to improve the Service.

Each party agrees to protect the other party's non-public information that is marked or reasonably should be understood to be confidential, and to use it only as necessary to perform under these Terms.

You represent that you are not located in, and will not use the Service from, any embargoed country and are not a prohibited party under applicable export control laws. You will comply with all applicable laws in connection with your use of the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYDECK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO DAILYDECK IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

You agree to defend, indemnify, and hold harmless DailyDeck and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service or violation of these Terms.

If you believe content on the Service infringes your copyright, please contact us at jacek@dailydeck.io with a detailed notice. We may remove content and terminate repeat infringers as required by law.

We may update these Terms from time to time. We will post the updated Terms on this page, and where appropriate we may also notify you by email. Your continued use after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of laws rules. You and DailyDeck consent to the exclusive jurisdiction and venue of the state and federal courts located in Minnesota.

• Entire Agreement: These Terms, together with our Privacy Policy and the terms of any third-party services you use, constitute the entire agreement between us.
• Severability: If any provision is unenforceable, the remainder remains in effect.
• Assignment: You may not assign these Terms without our consent.
• Waiver: Failure to enforce a provision is not a waiver.
• Force Majeure: We are not responsible for events beyond our reasonable control.

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your information.
