These Terms of Service ("Terms") govern your access to and use of the DailyDeck.io website and services (the "Service") provided by DailyDeck LLC ("DailyDeck," "we," "us," or "our"). 2.1 Eligibility

You agree to provide accurate, current, and complete information when creating your Account and to keep it updated. You may not share your credentials or create an account using a false identity or information you do not have the right to use.

2.3 Security

You are responsible for safeguarding your Account credentials and for all activities under your Account. Notify us immediately of any unauthorized use.

You agree not to, and will not permit others to:

• Use the Service in violation of any applicable law or regulation.
• Upload, post, or transmit malware, harmful code, or illegal content.

4.1 Plans & Renewals

Paid plans and current pricing are listed on our pricing page. Subscriptions renew automatically at the end of each billing cycle unless canceled.

4.2 Payments & Taxes

You authorize us and our payment processors to charge your payment method for applicable fees, taxes, and charges. You are responsible for any taxes associated with your Subscription.

4.3 Free Trials

If you enroll in a free trial, we will inform you of the trial duration. After the trial, unless you cancel, your Subscription will convert to a paid plan.

4.4 Upgrades, Downgrades, and Cancellations

Plan changes may take effect immediately or at the next billing cycle, as stated during checkout. You can cancel at any time; access remains until the end of the current term unless otherwise specified.

4.5 Refunds

Fees are non-refundable except where required by law or explicitly stated by us.

The Service may interoperate with third-party products or services. Your use of those services is governed by their terms and privacy policies, and we are not responsible for their actions or content.

We may offer features labeled as alpha, beta, or preview. These features are provided for evaluation, may be modified or discontinued at any time, and are provided "as is" without warranties.

We strive for high availability but do not guarantee uninterrupted Service. We may perform maintenance, updates, or changes without prior notice. Support channels and response times are described on our website and may change.

We and our licensors own all rights, title, and interest in and to the Service. You grant us a non-exclusive, worldwide, royalty-free license to use your User Content solely to provide and improve the Service. If you provide feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.

Each party agrees to protect the other party's non-public information that is marked or reasonably should be understood to be confidential, and to use it only as necessary to perform under these Terms.

You represent that you are not located in, and will not use the Service from, any embargoed country and are not a prohibited party under applicable export control laws. You will comply with all applicable laws in connection with your use of the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYDECK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO DAILYDECK IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

You agree to defend, indemnify, and hold harmless DailyDeck and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service or violation of these Terms.

If you believe content on the Service infringes your copyright, please contact us at support@dailydeck.com with a detailed notice. We may remove content and terminate repeat infringers as required by law.

We may update these Terms from time to time. If changes are material, we will provide notice by email or by posting a notice on the Service. Your continued use after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United States and the state or jurisdiction disclosed on our website, without regard to conflict of laws rules. The parties consent to the exclusive jurisdiction and venue of competent courts located in such jurisdiction.

• Entire Agreement: These Terms constitute the entire agreement between us.
• Severability: If any provision is unenforceable, the remainder remains in effect.
• Assignment: You may not assign these Terms without our consent.
• Waiver: Failure to enforce a provision is not a waiver.
• Force Majeure: We are not responsible for events beyond our reasonable control.
